The Higher Path LLC cannabis dispensary in Los Angeles faces a class action alleging the company sent promotional texts without permission in violation of the Telephone Consumer Protection Act.
Tyler Baker of Underhill, Vt., alleges he received four texts in May even though his number is on the national Do Not Call Registry, according to a complaint filed Monday in the U.S. District Court for the Eastern District of California.
The case underscores the risks businesses face under the telephone consumer law when sending texts. Companies face fines as high as $1,500 per text.
